Axis Surplus Insurance Co. v. Glencoe Insurance Ltd., No. D058963
In a suit for equitable contribution against a nonparticipating coinsurer by an insurer who settled a construction defect suit, an award of damages against the nonparticipating insurer is affirmed, where: 1) the settling insurer made a prima facie showing of potential coverage under the nonparticipating insurer's policy; and 2) the trial court did not abuse its discretion in its allocation of liability between the insurers.
